The forms listed below are specifically for pro se litigants who have entered a not guilty plea with the Court. These forms should not be used if the Court appointed a public defender to your case or if you have retained private counsel.
_________________________________________________________________________________________________ FORM 1: You must complete and submit (by email, regular mail or by dropping off) this form to the County Attorney’s Office (CAO) in order to view and/or receive copies of any evidence related to your case including: law enforcement reports video(s) and/or photos; surveillance video; 9-1-1 recordings; driving records; etc. Review the instructions carefully. Any fees must be paid by cash or check (credit/debit cards are not accepted). FORM 2: If you want to speak to the prosecutor assigned to your case, please read, complete and submit this form. FORM 3: You may electronically access and view FREE OF CHARGE the evidence related to your case (except for video recordings) as explained in this document. _________________________________________________________________________________________________ MCA 46-15-323: Within 30 days after the arraignment/initial appearance or at a later time as the court may for good cause permit, the defendant shall make available to the prosecutor for testing, examination, or reproduction: (a) the names, addresses, and statements of all persons, other than the defendant, whom the defendant may call as witnesses in the defense case in chief, together with their statements; (b) the names and addresses of experts whom the defendant may call at trial, together with the results of their physical examinations, scientific tests, experiments, or comparisons, including all written reports and statements made by these experts in connection with the particular case; and (c) all papers, documents, photographs, and other tangible objects that the defendant may use at trial. |
